Court: Praising Israeli Terrorist Is Not Incitement
Earlier today the Jerusalem Magistrate’s acquitted Michael Ben-Horin on charges of incitement to violence.
The charges against Ben-Horin are based on a 2003 television interview he gave on Purim in which he praised Baruch Goldstein.
Goldstein was an American-Israeli physician responsible for the massacre of 29 Muslims as they prayed at the Cave of the Patriarchs in Hebron in 1994:
“Far-right activist and the president of “Judea state” Michael Ben-Horin was acquitted Thursday by the Jerusalem Magistrate’s court of incitement to violence charges…..
..The charges stemmed from comments made by Ben-Horin during a Purim celebration in Kiryat Arba in 2003. He praised Goldstein on television, among other things declaring: “He is such a great and righteous man…he averted a massacre of Hebron Jews…Baruch Goldstein, there is nobody like you in the world.”
…Justice Li-Ran ruled that Ben-Horin’s comments do not constitute substantive incitement that may lead to violence. The judge also warned that limiting such remarks can lead to a slippery slope that would see “statements at the margins of legitimate discourse” banned.” {Source: Ynet News}
Praising a terrorist who killed 29 people as they prayed to the G-d of Abraham and Moses is not a criminal offence but commemorating the Nakba might be. How is that possible ?
